Terms of Service

1. Agreement to Terms

By accessing and using the services of Artamlapar Photography ("we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Services Description

Artamlapar Photography provides professional photography services including but not limited to:

• Wedding photography
• Portrait photography
• Commercial photography
• Event photography
• Landscape photography

All services are subject to availability and booking confirmation.

3. Booking and Payment Terms

3.1 Booking Process

• All bookings require a signed contract and deposit payment
• Booking dates are reserved only upon receipt of signed contract and deposit
• We reserve the right to decline any booking request

3.2 Payment Terms

• A non-refundable deposit of 50% is required to secure your booking
• Remaining balance is due 7 days before the scheduled event
• Late payment may result in cancellation of services
• All prices are in Canadian dollars unless otherwise specified

4. Cancellation and Refund Policy

4.1 Client Cancellation

• Cancellations more than 60 days before the event: 50% refund of payments made
• Cancellations 30-60 days before the event: 25% refund of payments made
• Cancellations less than 30 days before the event: No refund
• Deposits are non-refundable under all circumstances

4.2 Photographer Cancellation

In the unlikely event that we must cancel due to illness, emergency, or circumstances beyond our control, we will provide a full refund or assist in finding a suitable replacement photographer.

5. Copyright and Usage Rights

5.1 Copyright Ownership

Artamlapar Photography retains full copyright ownership of all photographs created during the session or event. This includes the right to use images for:

• Portfolio and marketing purposes
• Website and social media promotion
• Competition submissions
• Sample galleries and advertising

5.2 Client Usage Rights

Clients receive personal usage rights for delivered images, including:

• Personal sharing on social media
• Printing for personal use
• Sharing with family and friends

5.3 Restrictions

Clients may not:

• Sell or license images for commercial use without written permission
• Remove watermarks or copyright notices
• Alter images without permission
• Transfer usage rights to third parties

6. Delivery and Timeline

• Preview galleries will be available within 7-14 days after the event
• Final edited images will be delivered within 4-6 weeks for weddings
• Portrait sessions will be delivered within 2-3 weeks
• Commercial projects timeline will be specified in the contract
• Images are delivered via online gallery with download options

7. Limitation of Liability

7.1 Equipment Failure

While we maintain backup equipment and take all reasonable precautions, we are not liable for any loss of images due to equipment failure, memory card corruption, or other technical issues beyond our control.

7.2 Force Majeure

We are not liable for failure to perform due to circumstances beyond our control, including but not limited to natural disasters, government restrictions, venue closures, or health emergencies.

7.3 Maximum Liability

Our maximum liability under any circumstances shall not exceed the total amount paid for our services.

8. Model Release and Privacy

By booking our services, clients and subjects agree to:

• Allow Artamlapar Photography to use images for promotional purposes
• Understand that events may be photographed and shared publicly
• Release Artamlapar Photography from any claims related to the use of their likeness

If you prefer your images not be used for promotional purposes, please specify this in writing before the event.

9. Weather and Venue Policies

9.1 Weather Conditions

For outdoor sessions, we will monitor weather conditions and may recommend rescheduling for safety or quality reasons. No additional fees apply for weather-related rescheduling with reasonable notice.

9.2 Venue Access

Clients are responsible for ensuring we have proper access to all venues and locations. Any restrictions or additional fees imposed by venues are the client's responsibility.

10. Backup and Data Protection

• All images are backed up to multiple secure locations
• We maintain backup copies for a minimum of 12 months after delivery
• Clients are responsible for downloading and backing up their delivered images
• We are not responsible for images lost after delivery due to client's failure to download

11. Modifications and Updates

We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a new effective date. Continued use of our services after any changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by the laws of Ontario, Canada. Any disputes arising from these terms or our services shall be resolved in the courts of Ontario.
